Terms of Service

These Terms of Service (“Terms”) govern your use of Alex, an SMS-first social media assistant operated by Social Media Guardian, INC (“we,” “us,” “our”). By texting our number, creating an account, or using https://www.alexsocial.app/, you agree to these Terms and to our Privacy Policy.

1. The service

Alex helps businesses (including real estate professionals and other local service providers) request, review, and approve social-media posts. You typically start by texting our dedicated US number. We may also send a link so you can finish signup or manage your account in a browser. We draft captions and images, run compliance checks, and send you a private review link. Publishing to social networks may use connected third-party tools that you authorize.

2. SMS / text messages (required disclosure)

Alex is a two-way, customer-care SMS program. It is not a marketing blast list.

• How you opt in. You consent by texting the dedicated Alex number shown on our website at https://www.alexsocial.app/sms (or on any signup card or ad we give you). Your first text is your opt-in. We may also send a link so you can finish signup after you text us. We only message people who initiated contact or who are already a customer of this service.
• What we send. Onboarding questions, email verification codes and links, acknowledgements of your requests, status updates, and private links to review posts. Message frequency varies based on your use (typically a few messages per request).
• Rates. Message and data rates may apply.
• Opt out. Reply STOP to any Alex message to unsubscribe. You may receive a final confirmation. After that we will not send further SMS unless you opt in again (for example by texting us).
• Help. Reply HELP for help, or email pestes@gosocialagent.com.
• Carriers. Wireless carriers are not liable for delayed or undelivered messages.

You represent that you are the subscriber or customary user of the phone number you text from, and that you are at least 18 years old.

3. Accounts and your content

You are responsible for the accuracy of information you provide (name, email, license numbers, brokerage, brand assets, and post requests). You grant us a limited license to use that information and your brand materials solely to operate Alex for you — including generating draft posts and placing required advertising attribution on creatives.

Drafts may be produced with the assistance of third-party artificial intelligence providers. You remain responsible for reviewing, editing, and approving content before it is published, and for complying with advertising, licensing, and platform rules that apply to you (including real-estate advertising rules in your state).

4. Acceptable use

You may not use Alex to:

• Send spam, or text people who did not opt in
• Harass, defraud, or impersonate others
• Request or publish discriminatory housing advertising or other unlawful content
• Attempt to break into, scrape, or overload the service
• Violate Twilio, mobile-carrier, Meta, or other platform policies

We may suspend service if you violate these Terms or applicable law.

5. Third-party services

SMS delivery uses Twilio. Hosting, databases, email, image generation, and social publishing may use other processors (for example our hosting provider, database provider, AI model providers, and connected social posting tools). Their terms also apply to the parts of the service they provide.

6. Disclaimers

Alex is provided “as is.” We do not guarantee that every draft is error-free, that every SMS will be delivered, or that generated content will meet every legal requirement in your jurisdiction. You should review posts before approving them. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of liability

To the fullest extent permitted by law, Social Media Guardian, INC and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, arising from your use of Alex. Our total liability for claims relating to the service is limited to the amount you paid us for Alex in the three months before the claim, or one hundred US dollars (US $100) if you have not paid us.

8. Changes and termination

We may update these Terms by posting a new version at this URL. Continued use after the effective date means you accept the update. You may stop using Alex and reply STOP to end SMS. We may discontinue the service with reasonable notice where practical.
